Quick update on the International Data Transfers in the UK

On 2 February 2022, the UK Data Protection Authority (the “ICO”), confirmed that the Department for Culture, Media and Sport had laid before the Parliament the following:

  1. The UK version of the Standard Contractual Clauses (“SCCs”) called the International Data Transfer Agreement;
  2. The UK Addendum to be used alingside the EU SCCs, where data transfers are from both the EU and the UK; and
  3. A document setting out transitional provisions as to the use of the current standard data protection clauses for international transfers.

Once the above documents are formally approved, they will enter into force on 21 March 2022.

The ICO will publish soon some additional tools and guidance to support organisations on the implementation of these new documents.
